By using our website or by shopping in our stores, you acknowledge that you have read and understood these Terms and agree to be bound by them. They represent our entire agreement with you and supersede all prior terms, conditions, warranties and/or representations to the extent permitted by law.
We may periodically update or change the conditions and terms without giving you prior notice, we reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. You should check them regularly, as your continued use of our website or by shopping in our stores, you accept to be bound by any updated or revised Terms. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
By using the Caica website, you agree, on behalf of yourself and all members of your household and others who use any Service under your account, to the conditions provided herein. You are not authorized to use our website or shop in our stores if you do not agree to be bound by these Terms. When you use Caica Services, such that you send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other Caica Services, such as our Message Center, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
All content included in or made available through any Caica Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of Caica or its content suppliers and protected by The United Republic of Tanzania. The compilation of all content included in or made available through any Caica Service is the exclusive property of Caica and protected by The United Republic of Tanzania copyright laws.
You are required to have a valid payment method falling in any Mobile Network Operation in Tanzania being Tigo-Pesa, Airtel-Money, Halo-Pesa, Azam Pay and M-Pesa. We also recognize Bank payment being via Visa, Master or Gold card.
You may post reviews, comments, photos, videos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Caica reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant Caica a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Caica the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Caica for all claims resulting from content you supply. Caica has the right but not the obligation to monitor and edit or remove any activity or content. Caica takes no responsibility and assumes no liability for any content posted by you or any third party.
All purchases of physical items from Caica are made pursuant to a third-party delivery contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
• If you are for any reason dissatisfied with an item purchased from our stores or website, you may return it to Caica pharmacy store or through the applicable online channel for a full credit, refund, replacement or exchange, provided –
o You have the original tax invoice/till slip as proof of purchase;
o Items are returned within 7 (seven) days of purchase;
o The product has not expired;
o It is not damaged (including all packaging); and
o It is a returnable product (some items are by law, non-returnable for hygiene/health reasons).
• Defective products may be returned prior to the lapse of 7 (seven) days from the date of purchase.
• We do not guarantee that you will be automatically credited/refunded. The decision to credit/refund is solely at the discretion of the manager of the store where you return the product (or online manager), the original till slip has been handed in and they have inspected the condition of the item returned.
• For online returns, we reserve the right to ask you for photographs and written submissions detailing the reasons for the return before we process the return, and we may withhold reasonable transport costs if required.
• Please note: Caica will not accept any returns of any products of which the packaging has been removed, damaged, opened or tampered with, any products of a personal nature due to hygiene and sanitary considerations, any products due to pharmacy law requirements, or any medicines. Refunds are bank dependent and may take up to 10-14 working days to reflect.
• We reserve the right to ask you for proof of identification when returning products.
• Refund vouchers issued are valid for a period of 6 months from the date of issue.
• If for any reason you would like to cancel an order, you may contact our Customer Services Centre on 0……... While any cancellation of orders will be accepted at our sole and absolute discretion and we provide no warranty that any cancellation of any order will be accepted, any cancellation which we do accept will only be accepted in the event that you notify us of your intention to cancel prior to dispatch of the order in question.
• We reserve the right to debit your payment card for the delivery fees in respect of any cancellations. If you cancel your payment for any reason or if your payment card should cease to be valid for whatever reason, you will nevertheless be bound to pay to the full purchase price, including all costs incurred by us relating to the recovery thereof. Without prejudice to any other rights or remedies in law, we reserve the right to cancel forthwith any sale in the event of your breach any of the Terms.
• Use of our website is entirely at your own risk. We make no representations or warranties of any kind, whether express or implied. We do not warrant that the functions provided by the website will be uninterrupted or error free, or that the website or the server that makes it available are free from viruses or other harmful components. We accept no liability, to the extent permitted by law, for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused arising from the access or use of our website or the purchase of any of our products or services and on delivery. You expressly agree that your use of the Caica services is at your sole risk.
• You agree, to the extent permitted by law, to indemnify us against any loss or damage suffered or liability incurred by reason of any act or omission on your part or that of any third party acting on your behalf in connection with your use of our website and/or your purchase of any products or services.
• In the event that any clause contained in these Terms is invalid or unenforceable, then such clause shall not affect the validity or enforceability insofar as the remaining clauses of these Terms are concerned.
• We shall not be regarded as having waived, or be precluded from exercising any right under these Terms by reason merely that we have provided any indulgence to you or we fail to exercise or delay exercising any right we may have, whether the same right or any other right.
